Why is a licence required?


Article 3 of the Postal Services (Jersey) Law 2004 (the Law) provides that a licence issued by us is required to convey a letter from one place to another. Licence fees are based on the forecast cost of regulating the sector for the relevant year.

What types of licence are available?


Two types of licences are available:

  • Class I - for entities providing postal services, which are not designated as a public postal operator
  • Class II - for entities providing postal services, which are designated as a public postal operator and are subject to the universal service obligation

Are there exemptions to requiring a licence?


Yes, Article 7 of the Law sets out exemptions. In particular:

  • Article 7(1)(a) of the Law exempts from regulation any letter in respect of which the postal charge exceeds £1.30
  • Article 7(1)(b) exempts from regulation any letter weighing more than 500 grams

With respect to parcels, only those weighing 20 kg or less fall within the definition of a postal service. There is no requirement to hold a licence for providers of inbound parcel services on a commercial contract direct with a supplier. This means most parcel delivery is not subject to any licensing requirements in Jersey.

  • Business details
  • Service details

An application fee will also be required.

How many licensees are there?


There are currently two licensees, Jersey Post Limited (Jersey Post) and Hi-Speed Freight Services Limited (Hi-Speed Freight).

  • Jersey Post holds a Class II licence 
  • Hi-Speed Freight holds a Class I licence

What conditions does a Class I licence include?


The licence contains a number of obligations, including:

  • Protecting the integrity of mail
  • Developing postal facilities in accordance with international standards
  • Complying with any directions isssued by us in relation to information provision, quality of service monitoring and reporting
  • Consumer protection
  • Complying with international obligations

A Class I licence is usually awarded with conditions related to business and reporting against revenue ceiling.

What conditions does a Class II licence include?


The licence builds on the Class I licence and designates Jersey Post as a public postal operator and imposes the universal service obligation. This ensures all consumers have access to basic postal services at an expected service level.

 

It also contains additional provisions to the Class I licence, covering:

  • Postal schemes
  • Consumer protection
  • Fair competition.
