Why is a Licence required?


Under Article 3 of the Postal Services (Jersey) Law 2004 provides that a licence issued by the JCRA is required to convey a letter from one place to another, so to provide postal services.

Licence fees are based on the forecast cost of regulating the sector for the relevant year.

What types of Licence are available?


Two types of licences are available for the postal sector.

  • Class I - for entities providing postal services, which are not designated as a public postal operator; and
  • Class II - for entities providing postal services, which are designated as a public postal operator and are subject to the universal service obligation.

Are there exemptions to requiring a Licence?


Yes, Article 7 of the Law sets out exemptions. In particular:

  • Article 7(1)(a) of the Law exempts from regulation any letter in respect of which the postal charge exceeds £1.30.
  • Article 7(1)(b) exempts from regulation any letter weighing more than 500 grams.

With respect to parcels, only those weighing 20 kg or less fall within the definition of a postal service and there is no requirement to hold a licence for providers of inbound parcel services on a commercial contract direct with a supplier. This means most parcel delivery is not subject to any licensing requirements in Jersey.

How many Licensees are there?


There are only currently two Licensees, Jersey Post and Hi-Speed Freight Services Limited.

  • Jersey Post holds a Class II licence 
  • Hi-Speed Freight holds a Class I Licence

What does a Class I Licence include?


This contains a number of obligations, including to provide information to the JCRA; to protect the integrity of letters; to develop postal facilities in accordance with international standards; to comply with directions of the JCRA in relation to quality of service monitoring and reporting; to put in place consumer protection measures; and to enable Jersey to comply with international obligations.

A Class I licence is usually awarded with conditions related to business and reporting against revenue ceiling ('Financial Limitation').

What does a Class II Licence include?


This designates Jersey Post as a public postal operator and imposes the universal service obligation.

It builds on the Class I Licence and has additional provisions, covering postal schemes, consumer protection and various conditions designed to support fair competition.
