What are market studies?

Market studies examine consumer behaviour, business practices, market structure and other factors that influence market performance. They help identify whether actions are needed to address competition issues. Possible outcomes include:

  • A confirmation that the market is performing well
  • Actions focussing on consumers or businesses
  • Recommendations to businesses, the Government or the JCRA to improve market performance

If information received through a market study suggests a breach of competition law may have occurred, the study may be stopped to allow an investigation to be carried out.

Who decides which markets to examine?

Market studies may be initiated by:

  • The Government
  • The States Assembly
  • The JCRA

They can also be triggered by issues arising from mergers, complaints or concerns raised by consumer groups or competition authorities in other jurisdictions. We focus on markets where the greatest impact can be made for Jersey consumers.

How do we conduct a market study?

We will publish the study's scope and timeframe, then gather and analyse information to assess market structure and performance for consumers. This will involve a combination of:

  • Engaging with stakeholders
  • Requesting information from businesses and organisations
  • Conducting case study analysis
  • Reviewing market strategy and pricing
  • Considering economic theories and policies

A draft report is published for consultation, and the final report reflects this feedback. Market studies are flexible and exploratory; they are not formal investigations.
